On Aug 17, 2022, the fifth session of the Intergovernmental Conference on an international legally binding instrument under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction continued at the United Nations Headquarters in New York. The parties held informal discussions on the progress made over the past days.

The representative of Canada updated "Part III", area-based management tools, including marine protected areas. She said: “While there are differing views on the two options for area-based management tools, and whether MPAs should include sustainable use targets, many agree that area-based management tools are the broader term, marine protected areas are part of that, and the driving goals of marine protected areas are conservation-related, not necessarily to the exclusion of other purposes.”
