The Second Trial is Coming, for the Environmental Public Interest Litigation on Shanghai Xinghualou Group’s Mooncake Over-packaging

On December 20th, CBCGDF received a subpoena from the court handling our public-interest litigation on Shanghai Xinghualou’s Mooncake Over-packaging. This notification says that at 9:00 AM of January 11st, the second trial on this issue will be heard in public.
In September of the last year, CBCGDF found that a brand of mooncake that belongs to Shanghai Xinghualou Company did have over-packaging conduct. After three months’ efforts including investigation and inspection, CBCGDF finally sent all evidences for this issue to the Third Intermediate People's Court of Shanghai and officially sued this mooncake company. And now, we heard that the second trial of this litigation will be heard in the next year.

Obviously, the mooncake producer made their products beyond national standards on packaging. However, the court, during the first trial, believed that such conduct did not cause environmental pollution in any forms. From our perspective, this judgement will definitely help bring about more illegal behaviors in packaging and do great harm to environment protection against over-packaging and other conducts in commercial productions.

To prevent a vicious circle, CBCGDF decided to apply for a second trial.
Since every Chinese now live in a law-based society, here, CBCGDF firmly hold the view that actions that may destruct environment should be strictly inspected and severely punished by law. We sincerely wait for a more righteous judgement on this issue and hope every governmental sector, including judicial department, could set strict demands on themselves and regard environmental protection as a great part of the construction of ecological civilization. As China’s commercial development progresses, we must pay much attention to product packaging, avoid wasting, and reduce environment pollution.
