Nanning Customs Did not Publicly Responds to the Information about Pangolins, and CBCGDF Filed an Administrative Reconsideration with the General Administration of Customs

On December 19, 2018, Nanning Customs of Guangxi Zhuang Autonomous Region informed through a press conference that since 2016, Nanning Customs has investigated 83 cases of endangered animal and plant smuggling in a series of operations. With 707.78 kg ivory and 2578 pangolins were seized.

 

On December 27, 2018, in accordance with relevant provisions of Articles 3 and 26 of the “Wild Animal Conservation Law of the People's Republic of China” and the “Regulation of the People's Republic of China on the Administration of the Import and Export of Endangered Wild Fauna and Flora”, CBCGDF applied to Nanning Customs for the information disclosure of the 2578 pangolins’ species, source, survival condition, as well as the processing of their destinations (been transferred to the forestry departments, rescue centers, or other rescuing ways).

 

On January 7, 2019, CBCGDF received a reply from Nanning Customs on the relevant application, which reads: the customs government information applied by CBCGDF belongs to the prescribed internal management information and process information, of Article 14 (4) of the “Regulation of the People's Republic of China on the Disclosure of Government Information” and Article 12 (1) and (2) of the “Measures of the People's Republic of China for the Disclosure of Customs Government Information”, because they involve criminal cases, not to be made public.

 

On January 16, 2019, on the customs information disclosure reply by the Nanning Customs, CBCGDF filed an Administrative Reconsideration with the General Administration of Customs of People’s Republic of China in accordance with the relevant provisions of the “Regulation of the People's Republic of China on the Disclosure of Government Information”. The content includes: the “Reply for Customs Information Disclosure Application” made by the respondent shall be revoked according to law; the respondent shall be ordered to respond within the statutory time limit and the government information submitted by the applicant shall be disclosed.
