On the morning of February 24, 2023, the Working Committee on Biology and Science Ethics (BASE) of China Biodiversity Conservation and Green Development Foundation (CBCGDF), together with Institute for Animal Rule of Law affiliated to Zhongnan University of Economics and Law, held a seminar concerning the revision to Charity Law of the People’s Republic of China with the theme of charitable donation and animal protection for the public benefit. Experts and scholars in related fields, and representatives of social organizations participated in the meeting at invitation and exchanged opinions on the theme of the meeting.

Jin Jinping, Associate Professor from Law School of Peking University, suggested that “animal protection” be included in legislation as statutory charity activities. For regulating purposes, first of all, to set up a charitable organization with the purpose of “animal protection”; secondly, such organizations may carry out fund-raising activities to this end; and thirdly, donors in support of “animal protection” can enjoy the preferential treatment of pre-tax deduction of charity donations according to law.

However, in order to make the above-mentioned revision, we need to consider the following issues:

1. Charity stipulated in Charity Law must belong to the scope of social undertakings. That is, animal protection can also be classified in the category of social undertakings, which is different from market competition.

2. It is advisable to prove the charitable nature of animal protection, explaining how this kind of actions can increase public benefits.

3. Charitable activities defined by law refer to activities that bring benefits to the unspecified public or part of the unspecified public.

4. The specifics of animal protection should be consistent with the history, culture, national conditions and social consensus of the country, as well as its current development stage.
