Gao Guilin: National Forestry and Grassland Administration Shall Conduct a Special Investigation on the Asian Elephant Incident and Announce the Results to Respond to Public Inquiries

An Asian elephant was born in Kunming Zoo, Yunnan in 2016. At the age of 2, Kunming Zoo exchanged it to Jiaozuo, Henan. After the Asian elephant was sent to Henan, some netizens reported that they were found the elephant was chained in the park in Jiaozuo, playing the harmonica, performing handstands and being ridden by tourists. As a result, it has been widely suspected of being abused. Recently, it has become a hot topic on the Internet.

 

In order to keep abreast of its current situation, the Research Department of China Biodiversity Conservation and Green Deveopment(CBCGDF) has reported to the National Forestry and Grass Administration, the Ministry of Housing and Urban-Rural Development, Jiaozuo Qinyang Hesheng Forest Zoo, Qinyang Swan Lake Ecological Park, Kunming Zoo and other relevant units on January 18, 2022. Requested disclosure of information, but received a less than ideal response.

In order to truthfully grasp its current situation, on January 18, 2022, the Research Department of CBCGDF applied for information disclosure to National Forestry and Grass Administration, Ministry of Housing and Urban-Rural Development, Jiaozuo Qinyang Hesheng Forest Zoo, Qinyang Swan Lake Ecological Park, Kunming Zoo and other related units, but the response it received was not satisfactory.

In order to further respond to social concerns and promote the research and scientific popularization of wildlife protection-related issues, on April 29, the Research Department of CBCGDF held the Seminar on "Asian elephant and anti wildlife abuse".

 

The Seminar invited Professor Gao Guilin, a professor and doctoral supervisor of the Law School of Capital University of Economics and Business.

Gao Guilin attended the seminar and delivered a speech. The main content of the speech is as follows:

1. Can the use of elephants in Qinyang Swan Lake Ecological Park become a commercial secret?

Asian elephants are forced to perform, which obviously violates the purpose of breeding the population, goes against the requirements of social morality, and goes against the relevant regulations of the state. The CBCGDF's request to disclose the above-mentioned matters related to Asian elephants is justified. Qinyang Swan Lake Ecological Park refused to disclose it on the grounds of commercial secrets without legal basis, and its claim that the National Forestry and Grassland Administration should not be adopted. The National Forestry and Grassland Administration should not listen to the opinions of the parties involved in the Qinyang Swan Lake Ecological Park, but should instead conduct a special investigation into the content of the relevant contracts and the use of elephants, and announced the investigation results to respond to public inquiries.

 

2. The use of elephants in Qinyang Swan Lake Ecological Park shall be approved by the competent department of wildlife protection in advance. 

 

3. Netizens buy tickets to watch Asian elephants perform handstands and other performances that endanger their own safety, and have the right to know whether Asian elephants have been abused when practicing these skills.
