The article "a kind of power is deeply involved in the Internet" released by the CAIJING ELAW yesterday mentioned the public interest litigation cases and interview with Ma Yong, Deputy Secretary General of CBCGDF, in the field of e-commerce. To promote the public spirit of environmental protection, the International Department of CBCGDF translated the part of article as follow:
In 2016, CBCGDF filed a public interest lawsuit against Shenzhen Sumei company and Zhejiang Taobao Network Co., Ltd., that the "annual inspection cheating device " sold by Shenzhen Sumei on Taobao made a large number of car owners avoid the annual inspection of automobile exhaust, which led the increase of air pollution. Therefore, CBCGDF requested the court to order the two defendants to jointly bear 150 million yuan of ecological environment restoration costs.
In the end, the court ordered Shenzhen Sumei Company to compensate 3.5 million yuan, while Taobao was not jointly and severally liable. This public interest lawsuit case was selected into the "top ten influential lawsuits in China in 2019" on the grounds that it helps to further clarify the responsibility for air pollution in the network era and expand the types of environmental public interest litigation.
Ma Yong, Deputy Secretary General of CBCGDF, said in the interview with CAIJING ELAW that he hoped Taobao can take social responsibility to promote its comprehensive prohibition of online and sales of illegal products, and protect social and public interests.
