On April 26, 2023, the Second Session of the Standing Committee of the 14th National People’s Congress voted to pass the “Law on Ecological Protection of the Qinghai-Tibet Plateau”, which will come into effect on September 1, 2023.

The Legal Working Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF) attaches great importance to the formulation of the law and submitted multiple revision suggestions.

The Legal Working Committee of CBCGDF suggests increasing the role of public welfare organizations, volunteers, and others in the law. To protect the Qinghai-Tibet Plateau, attention should be paid to the participation of social forces. It is recommended to establish provisions to encourage the participation and supervision of social forces such as public welfare organizations and volunteers, and that social organizations can file public interest lawsuits as civil litigation subjects for ecological damage incidents.

The Legal Working Committee of CBCGDF also suggests establishing a protection mechanism for genetic resources, especially some germplasm resources. There should be articles to strengthen and clear establishment of a biological resource bank in the Qinghai-Tibet Plateau region.

In response to the issue of overgrazing, the Legal Working Committee of CBCGDF suggests there should be specific requirements and indicators, such as the original grazing capacity, the range of grazing prohibition, etc.
