Recently, China Biodiversity Conservation and Green Development Foundation (CBCGDF) applied to the Ministry of Ecology and Environment for the environmental inspection information which the Central Ecological and Environmental Protection Inspection Team had feedbacked to GuiZhou Province. The Ministry of Ecology and Environment answered that the information CBCGDF had applied for is the information formed by the Central Ecological and environmental Protection Supervision Team during the inspection and supervision which is not included in the government information as referred to Article 2 of the Regulations on The Disclosure of Government Information issued by the Ministry of Ecology and Environment. CBCGDF decided their reply was not valid and filed an administrative review to the Ministry of Ecology and Environment.
CBCGDF will follow up and update the progress of the administrative review.
Case Background:
In December 2021, the Central Ecological and Environmental Protection Inspection Team 2 inspected Guizhou and found that Maiba Bauxite Mine of Huangping Fucheng Industrial Co., Ltd had illegal problems of serious ecological damage, and had been punished 62 times by relevant departments in the past three years.
CBCGDF was highly concerned and filed an application for inspection information disclosure to the local ecological environment authority, however, the reply was: The company under supervision has never been investigated by the local government departments.
In order to timely and accurately grasp the inspection information about the company, CBCGDF applied to the Ministry of Ecology and Environment for the 62 administrative penalty documents and relevant materials of the inspection formed by the Central Ecological and Environmental Protection Supervision Team 2.
On May 10, 2022, CBCGDF received the reply from the Ministry of Ecology and Environment as the "Notice of Disclosure of Government Information upon Application". CBCGDF was told that the information CBCGDF had applied for is the information formed by the Central Ecological and environmental Protection Inspection Team during the inspection and supervision which is not included in the government information as referred to Article 2 of the Regulations on The Disclosure of Government Information issued by the Ministry of Ecology and Environment (as below).
