At present, China's air pollution situation is grim, haze occurs frequently, and vehicle exhaust pollution has become an important source of air pollution. The China Biodiversity Conservation and Green Development Foundation (CBCGDF) continues to pay close attention to the problem of motor vehicle pollution and has effectively solved it through a series of legal actions. The public interest lawsuit brought by CBCGDF against the illegal sale of "annual inspection equipment" on Taobao. It is a typical case.

Recently, the CBCGDF received a court summons from the Zhejiang Provincial Supreme People's Court. The CBCGDF sued Shenzhen Sumei Company and Taobao for the illegal sale of "annual inspection equipment" public interest litigation case for the second trial. It will hold a hearing in the Zhejiang Provincial Supreme People's Court on the morning of August 23, 2019.

Review of the case:

On October 26, 2016, the CBCGDF filed a lawsuit against Zhejiang Taobao Network Co., Ltd., Shenzhen Sumei Environmental Protection Co., Ltd. for illegal sale and production of automobile annual inspection equipment with the Hangzhou Intermediate People's Court. It formally filed a civil environmental public interest litigation, and relevant lawsuit materials have been received by Hangzhou Intermediate People's Court.

On October 29, 2016, the CBCGDF submitted an application for evidence preservation to the Hangzhou Intermediate People's Court of Zhejiang Province in response to the case.

On November 10, 2016, the CBCGDF received a notice of acceptance of the Hangzhou Intermediate People's Court case. The case number is (2016) No. 1269, Zhejiang 01. The case of CBCGDF sued Shenzhen Sumei Environmental Protection Co., Ltd. and Zhejiang Taobao Network Co., Ltd. environmental public interest litigation was formally filed.

On December 19, 2016, the CBCGDF received the civil ruling of the Hangzhou Intermediate People's Court.

On December 22, 2016, CBCGDF received a civil ruling of jurisdiction objection from Shenzhen Sumei Environmental Protection Co., Ltd., one of the defendants of Taobao Public Interest Litigation rejected by Hangzhou Intermediate People's Court.

On June 19, 2017, the CBCGDF sued Shenzhen Sumei Company and Taobao for the illegal sale of "annual inspection equipment". The Hangzhou Intermediate People's Court organized the plaintiff and defendant to exchange evidence before the court.

On September 7, 2018, the case was heard in Hangzhou Intermediate People's Court.

On June 5, 2019, the CBCGDF received the civil judgment of the Hangzhou Intermediate People's Court.

On June 13, 2019, the CBCGDF submitted an appeal to the Zhejiang Provincial Supreme People's Court.
