China’s First EPIL Case on Public Places Indoor Tobacco Control Filed by CBCGDF Shows Initial Results: Smoking Rooms in the Shopping Malls Involved are Suspended, Smoking Signs are Covered or Smeared

On the weekend of 22nd June, volunteers of China Biodiversity Conservation and Green Development Foundation (CBCGDF) went to the children's themed shopping mall which is the defendant of China's first environmental public interest lawsuit of smoking control in indoor public places and found that the “Not in use” has been posted in the smoking room of the shopping mall and the smoking sign had been covered or painted.

 

This is the effect of the active litigation after the case was filed and accepted. It is hoped that this case can further promote the comprehensive smoking control in public places, enhance the awareness of smoking control in the whole society, and unveil laws and regulations as soon as possible to protect public life and health.

 

The review of the progress of the case:

 

On 15th May 2019, the CBCGDF instituted the China's first environmental public interest lawsuit of smoking control in indoor public places, Baoding Intermediate People's Court was formally put on a record and accepted and accepted the application for evidence preservation submitted by the CBCGDF.

 

On 16th May 2019, Baoding Intermediate People’s Court has been executed the application for evidence preservation submitted by the CBCGDF.

 

On 17th June 2019, the CBCGDF received the ruling paper that the defendant raises a jurisdiction objection from the court.
