The First Case on Public Places Indoor Tobacco Control in China: The Court Rejected the Defendant's Jurisdictional Objection | EPIL of CBCGDF

Recently, China Biodiversity Conservation and Green Development Foundation (CBCGDF) received a civil ruling of Baoding Intermediate People's Court on indoor tobacco control environmental pubic interest litigation (EPIL) ((2019) Ji 06 Minchu No. 134) as follows:

 

To rule on the jurisdictional objection raised by the defendant in the case: to reject the jurisdictional objection raised by the three defendants in the case.

 

This case is China's first EPIL case on public places indoor tobacco control. It is also the first case in which environmental protection and tobacco control appeals are simultaneously reflected in public interest litigation.

 

Case review:

 

On May 15, 2019, China’s first EPIL case on public places indoor tobacco control filed by CBCGDF was formally accepted by the Baoding Intermediate People’s Court, while the Baoding Intermediate People’s Court accepted the application for evidence preservation, it was filed by CBCGDF.

 

On May 16, 2019, the Baoding Intermediate People’s Court completed the implementation of evidence preservation in this case.

 

On May 31, 2019, World No Tobacco Day, the CBCGDF invited experts in law, tobacco control, disease control, and juvenile protection to discuss this China's first EPIL case on public places indoor tobacco control.
