Yesterday, CBCGDF received an administrative judgment from the People’s Court of Daye City, Hubei Province, and sentenced CBCGDF’s suing the Daye City Environmental Protection Administration for failing to perform the statutory duties of information disclosure (the judgment is as the photos shown). It supported the CBCGDF’s litigation request and ruled that the defendant Daye City Environmental Protection Administration to perform the statutory duties of the government information disclosure to the plaintiff China Biodiversity Conservation and Green Development Foundation within 15 days after the judgment came into effect.

This case was the first administrative lawsuit filed by CBCGDF and concluded. After the Daye City Environmental Protection Administration involved in this case fulfills its information disclosure obligations, CBCGDF will synthesize relevant evidence materials and timely bring environmental civil public interest litigation to relevant enterprises that cause heavy metal pollution in Daye area to effectively protect environmental rights and social environmental public interest.

Case review:

In October 2017, CBCGDF received reports from volunteers, reflecting the Daye Nonferrous Metals Co., Ltd. of Huangshi City, Hubei Province discharged pollutants involving heavy metals in the production process all the year round, causing soil and rice in the surrounding areas to be contaminated by heavy metals, seriously infringing on the environmental rights and health of the people. CBCGDF highly concerned and immediately hires professional and qualified testing institutions to rush to the field to take soil and rice samples for testing. The report shows that the cadmium content of soil samples and rice samples are seriously exceeded.

CBCGDF applied to the Daye Environmental Protection Administration for disclosure of environmental information about the company on November 16, 2017 and January 18, 2018, respectively, but has not received an information public reply from the Daye Environmental Protection Administration.

On March 9, 2018, CBCGDF filed an administrative lawsuit against the Daye City Environmental Protection Administration for failing to perform the statutory duties of government information disclosure in accordance with the law.

On March 19, 2018, CBCGDF received the notice of acceptance of the case of Daye City People’s Court.

On May 18, 2018, CBCGDF received a subpoena from the Daye City People’s Court.

On June 13, 2018, CBCGDF appeared in court to participate in the pre-trial meeting held by the Daye City People’s Court on the case.

On August 31, 2018, CBCGDF appeared in court to participate in the trial held by the Daye City People’s Court on the case.

On September 14, 2018, the Daye City People’s Court pronounced the administrative judgment of the case in court.

On September 17, 2018, CBCGDF received the administrative judgment of the Daye City People’s Court.
