V. Encourage the news media and the public to supervise illegal activities


The protection of wild animals by administrative law enforcement alone is far from enough. It requires the extensive participation and support of the whole society, and it is particularly important to encourage the active participation of news media and professional social organizations. A good atmosphere of supervision by the whole people is formed, which makes the offender not to dare, unable, and unwilling to engage in illegal transactions involving wild animals, overeating, and destruction.


It is recommended to add two provisions to Article 6 of the Regulations, namely: "News media, social organizations, etc. should carry out public welfare advocacy around wildlife protection laws and regulations and protection knowledge and conduct public opinion supervision on illegal acts.


All units and individuals have the obligation to protect wild animals, their genetic resources and habitats, and have the right to report or accuse violations of these regulations. "


VI. Restrict the breeding of wild animals as pets


At present, the phenomenon that some people raise wild animals as pets is frequent, leading to increased risks of zoonotic diseases and invasion of alien species. There is a great hidden danger of risks that endanger public health safety, ecological safety, and public order. It is recommended to add an article after Article 27 of the Regulations, which clearly stipulates that the wild animals that grow and reproduce in the wild nature kept as pets.


VII. Special chapter detailing the relevant systems prohibiting illegal wildlife trade


In order to cut off the chain of interest in illegal wildlife trading, it is urgent to refine the relevant regulations prohibiting illegal wildlife trading. However, the "Regulations" lack the relevant provisions prohibiting illegal wildlife trade, which is not conducive to the full implementation of the "Decision" of the NPC Standing Committee.


It is recommended that the "Regulations" add a chapter "Illegal Trading", specifically prohibit the sale, purchase and use of wildlife protected by these regulations, and strengthen the management of non-edible use and circulation.


VIII. Establish a management mechanism for the scientific release of wildlife


It is recommended that the "Regulations" add an "Establishment of a management mechanism for the scientific release of wild animals. Establish a consultation mechanism for the decision-making of biological safety of wild animals, organize experts and relevant parties to carry out scientific assessment, research and judgment of biological safety, and organize the release of qualified wild animals in a timely manner. The municipal government is responsible for establishing a consulting expert database for biosafety decision-making.” after Article 31.


IX. Provisions for the establishment of dedicated chapters on information disclosure and public participation


Information disclosure is an important means to protect the public ’s right to know and establish the credibility of government departments, and it is also an important way to urge government departments to do well in wildlife protection and management. It’s recommended that the "Regulations" establish special chapters for information disclosure and public participation. Timely disclosure of information related to the monitoring of epidemic diseases, containment and rescue, management of artificial breeding, management of hunting and quotas, management of non-edible use transactions, emergency disposal, and law enforcement management. And introduce public participation in the licensing process involving the use of wild animals. In particular, the approval of the use of precious wild animals peculiar to Beijing shall set up a hearing procedure, and invite experts, social organizations, and the public to submit opinions for scientific decision-making.
