CBCGDF Suggests that Beijing People’s Procuratorate Should File an Administrative Public Interest Lawsuit Against Beijing Gardening and Greening Bureau

On January 2nd, China Biodiversity Conservation and Green Development Foundation (CBCGDF) formally sent a letter to Beijing People’s Procuratorate, suggesting that a public interest lawsuit should be filed against Beijing Gardening and Greening Bureau on suspicion of administrative violations.

 

The incident originated from the discovery of pangolin protection work by CBCGDF that Beijing Gardening and Greening Bureau was suspected of illegally approving Beijing Shengshi Xingwen Culture Development Co., Ltd. (hereinafter referred to as “Shengshi Company”) to sell pangolin scales to Anguo Juyaotang Pharmaceutical Co., Ltd. According to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the Wildlife Protection Law of China, the pangolin is key protected wildlife in China, and it is prohibited to sell, purchase and use the national key protected wildlife and its products in China.

 

In order to further understand the situation of Shengshi Company’s sale of pangolin scales, CBCGDF applied to Beijing Gardening and Greening Bureau for information disclosure. However, the reply of Beijing Gardening and Greening Bureau is basically based on the reason that “information does not exist” or “commercial secrets are involved”. In order to urge Beijing Gardening and Greening Bureau to correct administrative illegal acts as soon as possible and perform its duties in accordance with the law, CBCGDF suggested Beijing People’s Procuratorate to investigate and verify the case, and need to file an administrative public interest lawsuit against Beijing Gardening and Greening Bureau in accordance with the law. CBCGDF is willing to actively cooperate with Beijing People’s Procuratorate to do a better job in related work, further promote the protection of pangolin, and will also pay close attention to the follow-up progress of this incident.
